Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of ProlongHealth.ai and related services offered or facilitated by Mobile IV Infusions LLC, doing business as ProlongHealth (“ProlongHealth,” “we,” “us,” or “our”).
By accessing ProlongHealth.ai, creating an account, submitting information, purchasing a service, or using services made available through ProlongHealth, you agree to these Terms and our Privacy Policy and Refund & Cancellation Policy.
If you do not agree to these Terms, do not use the website or services.
1. About ProlongHealth
ProlongHealth operates a healthcare management, technology, and service platform designed to help individuals access health and wellness services.
Certain healthcare services accessible through ProlongHealth are provided by appropriately licensed healthcare professionals and professional medical entities.
ProlongHealth may provide or facilitate administrative, technology, customer-support, marketing, scheduling, payment, fulfillment coordination, and other non-clinical services.
Except to the extent ProlongHealth separately provides a service through appropriately licensed personnel as permitted by law, ProlongHealth itself does not independently diagnose medical conditions, prescribe medications, or substitute its judgment for the independent professional judgment of a licensed healthcare provider.
2. Telehealth Services
Certain services available through ProlongHealth involve telehealth.
Telehealth allows healthcare services to be provided through electronic communications and technology rather than exclusively through an in-person encounter.
Availability of telehealth services depends on factors including your location, applicable law, provider licensure, medical appropriateness, and service availability.
Submission of information or payment does not guarantee that you will qualify for treatment.
3. Licensed Healthcare Providers
Clinical evaluations, diagnoses, treatment recommendations, prescribing decisions, and other medical decisions are made by appropriately licensed healthcare professionals.
Healthcare providers exercise independent professional judgment.
ProlongHealth does not require a provider to prescribe a particular medication or approve a requested treatment.
A provider may determine that a requested treatment is inappropriate, recommend an alternative, request additional information or testing, require an in-person evaluation, or decline treatment.
4. Medical Evaluation
Certain services require completion of a medical evaluation before treatment may be provided.
You agree to provide complete, truthful, current, and accurate information during the medical-evaluation process.
Information intentionally omitted or inaccurately reported may affect your eligibility for treatment and may create serious health risks.
Completing a questionnaire, submitting an intake, making payment, or requesting a specific treatment does not guarantee approval or issuance of a prescription.
5. TrueEval/TrueEHR and Clinical Technology
ProlongHealth may use third-party clinical and technology infrastructure, including TrueEval/TrueEHR, to facilitate patient intake, medical evaluations, provider workflows, scheduling, laboratory services, prescriptions, billing, and related healthcare operations.
When you choose to proceed with a medical evaluation, information necessary to initiate that process may be transmitted to the applicable clinical platform or healthcare provider.
Third-party clinical platforms and providers may maintain separate terms, consent forms, privacy notices, and other agreements that apply to their services.
6. Prescription Medications
Prescription medications are available only when prescribed by an appropriately licensed healthcare professional who determines that treatment is medically appropriate.
ProlongHealth does not guarantee:
- Approval for any particular medication;
- A particular dosage;
- Continued prescribing;
- Treatment effectiveness;
- Specific clinical outcomes; or
- Availability of any particular medication.
A provider may change or discontinue treatment based on clinical judgment.
You must use prescription medication only as directed by the prescribing healthcare professional.
You should not share prescription medications with another person.
7. Compounded Medications
Some treatment options may involve compounded medications when prescribed by an appropriately licensed healthcare provider and otherwise permitted by applicable law.
Compounded medications are not FDA-approved in the same manner as FDA-approved drug products. FDA does not verify the safety, effectiveness, or quality of compounded drugs before they are marketed.
Availability of compounded medication may change due to applicable law, regulatory requirements, pharmacy availability, supply conditions, or provider judgment.
ProlongHealth does not guarantee continued availability of any compounded medication.
8. Pharmacies
Prescriptions may be transmitted to participating pharmacies or other dispensing entities as permitted by law.
Pharmacies are responsible for dispensing medications according to applicable pharmacy laws, professional requirements, and prescriptions issued by licensed healthcare providers.
Medication availability, formulation, packaging, fulfillment, and delivery times may vary.
9. Laboratory Services
Certain treatments may require or recommend laboratory testing.
Laboratory services may be performed by independent laboratories, collection facilities, or other diagnostic service providers.
Laboratory availability, pricing, collection options, turnaround times, and testing requirements may vary.
Laboratory results must be interpreted in the appropriate clinical context. Information displayed through ProlongHealth or an automated system is not a substitute for evaluation by an appropriately qualified healthcare professional.
10. Artificial Intelligence and Automated Technology
ProlongHealth may use artificial intelligence, automation, algorithms, or similar technologies for non-clinical purposes including website navigation, customer support, education, administrative assistance, service navigation, analytics, and business operations.
Unless expressly identified as part of a provider-directed clinical service, an AI assistant or automated tool available through ProlongHealth:
- Is not a physician or other licensed healthcare professional;
- Does not independently diagnose medical conditions;
- Does not independently prescribe medication;
- Does not establish a clinician-patient relationship;
- Is not a substitute for professional medical judgment; and
- Should not be relied upon for emergency medical decisions.
Information generated by automated technology may contain errors and should be evaluated accordingly.
11. Not for Medical Emergencies
ProlongHealth.ai and its online services are not emergency medical services.
Do not use the website, an AI assistant, email, text messaging, or telehealth intake process for a medical emergency.
If you believe you are experiencing a medical emergency, seek immediate emergency medical assistance through appropriate local emergency services.
12. Local Mobile IV Therapy
ProlongHealth may offer mobile IV therapy and other in-person services in designated geographic areas, including portions of the Tampa Bay, Florida region.
Availability depends on staffing, location, clinical appropriateness, provider authorization where required, and applicable law.
A requested appointment is not guaranteed until confirmed.
Clinical personnel may decline, postpone, or discontinue a service when they determine that providing the service would be inappropriate or unsafe.
13. Eligibility and Age
Unless expressly stated otherwise for a particular service, ProlongHealth services are intended for adults who are at least 18 years old.
You represent that information submitted about yourself is accurate and that you are legally capable of entering into these Terms.
Certain treatments may have additional eligibility requirements.
14. Geographic Availability
ProlongHealth may make different services available in different states or geographic areas.
A service appearing on the website does not guarantee that the service is legally or clinically available in your location.
Availability may change without notice due to provider coverage, licensure, pharmacy availability, regulatory changes, laboratory availability, or other circumstances.
15. Pricing
Prices displayed on ProlongHealth.ai are subject to change.
Unless expressly stated otherwise, displayed prices may not include every potential cost associated with treatment, including additional laboratory testing, follow-up evaluations, shipping, pharmacy costs, or other services that become medically necessary or are separately requested.
The applicable price and included services should be presented before the relevant purchase or enrollment when reasonably practicable.
16. Payments
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize applicable charges for services you purchase.
Payment processing may be performed by independent payment processors.
You are responsible for reviewing charges and promptly notifying ProlongHealth of suspected billing errors.
17. Refunds and Cancellations
Refunds, cancellations, medication orders, laboratory orders, mobile IV appointments, subscriptions, no-shows, and related matters are governed by the ProlongHealth Refund & Cancellation Policy, which is incorporated into these Terms by reference.
18. Memberships and Recurring Charges
Certain services may be offered through subscriptions, memberships, or recurring treatment programs.
When enrolling in a recurring program, you authorize recurring charges according to the pricing and frequency disclosed during enrollment until the program is canceled.
You may cancel future recurring charges according to the cancellation process applicable to the program.
Cancellation does not automatically provide a refund for services, provider evaluations, prescriptions, medications, laboratory services, shipments, or other benefits already provided, initiated, or incurred.
19. Communications
By providing contact information, you authorize ProlongHealth and applicable service providers to communicate with you regarding your requests, account, transactions, appointments, medical-evaluation process, customer support, and other service-related matters as permitted by law.
Communications may occur by email, telephone, text message, portal notification, or other appropriate methods.
Separate consent may be requested for promotional or marketing communications where required.
20. SMS/Text Messaging
If you affirmatively consent to receive SMS/text messages, message frequency may vary and message and data rates may apply.
Consent to receive marketing text messages is not a condition of purchasing goods or receiving healthcare services unless otherwise permitted by law.
You may generally reply STOP to opt out of marketing text messages and HELP for assistance, subject to the terms presented when you enroll.
21. User Responsibilities
You agree not to:
- Provide false or misleading information;
- Impersonate another person;
- Obtain prescription medication for another person through your account;
- Misuse prescriptions or healthcare services;
- Attempt unauthorized access to systems or accounts;
- Interfere with website or platform security;
- Introduce malicious software or code;
- Scrape or systematically extract protected website content without authorization;
- Use the website for fraudulent or unlawful purposes; or
- Violate applicable laws or regulations.
ProlongHealth may restrict or terminate access when reasonably necessary to address suspected fraud, abuse, security threats, unlawful conduct, or violations of these Terms.
22. Intellectual Property
The ProlongHealth name, branding, logos, website design, graphics, original text, software, and other proprietary materials are owned by or licensed to ProlongHealth and are protected by applicable intellectual-property laws.
Except as permitted by law, you may not reproduce, distribute, modify, sell, commercially exploit, or create derivative works from proprietary ProlongHealth materials without authorization.
23. Third-Party Services and Links
ProlongHealth may integrate with or link to healthcare providers, pharmacies, laboratories, payment processors, technology platforms, shipping companies, and other third parties.
ProlongHealth does not control every aspect of independent third-party services.
Your use of a third-party service may also be governed by that party's terms, privacy policies, consents, and other agreements.
24. Website Availability
We strive to maintain reliable access to ProlongHealth.ai but do not guarantee uninterrupted or error-free operation.
The website or particular features may occasionally be unavailable because of maintenance, updates, outages, cybersecurity events, third-party failures, or circumstances beyond our reasonable control.
25. No Guarantee of Results
Healthcare outcomes vary among individuals.
ProlongHealth does not guarantee weight loss, hormone levels, hair growth, improved sexual function, laboratory values, longevity outcomes, symptom improvement, or any other specific medical or wellness result.
Testimonials, examples, educational materials, or descriptions of potential outcomes do not constitute guarantees that another individual will experience the same result.
26. Educational Information
General information available through ProlongHealth.ai is provided for informational and educational purposes.
General website content is not individualized medical advice and should not be interpreted as establishing a clinician-patient relationship.
Individualized medical decisions should be discussed with an appropriately licensed healthcare professional.
27. Privacy
Use of ProlongHealth.ai is also subject to our Privacy Policy.
Where protected health information is maintained by a HIPAA-covered healthcare provider or its business associate, additional privacy rights and obligations may apply under the applicable provider's Notice of Privacy Practices.
28. Disclaimer of Warranties
To the fullest extent permitted by applicable law, ProlongHealth.ai and non-clinical platform services are provided on an “as is” and “as available” basis.
ProlongHealth does not warrant that the website will always be uninterrupted, error-free, completely secure, or suitable for every user's particular purpose.
Nothing in this section limits obligations or warranties that cannot lawfully be excluded.
29. Limitation of Liability
To the fullest extent permitted by applicable law, ProlongHealth will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of or inability to use the website or non-clinical platform services.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited, including rights that may apply under healthcare, consumer-protection, or other applicable laws.
30. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless ProlongHealth and its officers, employees, and agents from claims, damages, or expenses arising from your unlawful misuse of the website, fraudulent activity, violation of these Terms, or infringement of another person's rights.
This provision does not apply to the extent prohibited by applicable law.
31. Governing Law
Except where applicable law requires otherwise, these Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Nothing in this section eliminates consumer protections or other rights that applicable law requires to be available to residents of another jurisdiction.
32. Disputes
If a dispute arises concerning ProlongHealth's non-clinical website or administrative services, we encourage you to contact ProlongHealth first so that we may attempt to resolve the matter.
Any mandatory dispute-resolution, arbitration, jury-waiver, or class-action-waiver provision must be separately and clearly presented where applicable and enforceable.
These Terms do not create a mandatory arbitration agreement unless ProlongHealth separately adopts and presents one in a legally enforceable manner.
33. Changes to These Terms
We may update these Terms periodically to reflect changes in our services, business practices, technology, or legal requirements.
Updated Terms will be posted on ProlongHealth.ai with a revised “Last Updated” date.
Where required by law, we may provide additional notice or request renewed acceptance of material changes.
34. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
35. Entire Agreement
These Terms, together with policies and agreements expressly incorporated by reference, constitute the agreement governing your use of ProlongHealth.ai and applicable non-clinical ProlongHealth services, except where separate healthcare-provider, pharmacy, laboratory, or other third-party agreements apply.
